Violation and Penalty Assessment

What happens if you overstay your visa or residence permit?

An overstay is a problem that grows the longer it is ignored; handled with the right step early on, it can often be managed.

Consequences of an overstay

  • Administrative fine: If the legal period of stay is exceeded, an administrative fine proportional to the length of the overstay, and updated every year, is imposed.
  • Entry ban: Depending on the length of the overstay and whether departure was voluntary, after paying the fine, or following a deportation order, an entry ban to Türkiye of up to five years (longer in certain cases) may apply.
  • Unpaid fines: Failing to pay a fine notified at departure is a factor that extends the entry ban.

The right steps after an overstay

  1. Don't let it grow: The longer the overstay, the greater the risk of both fines and bans; the legal situation must be clarified as soon as you notice it.
  2. Have your status checked: In some cases a valid application route (residence application, work permit process) may still be open; in others, the least damaging departure is planned.
  3. If you leave, keep the paperwork: Keep the documents on the fines and procedures notified at the border gate; you will need them for future visa/permit applications.
